Terms of Service
These terms govern your use of Planespot, Trainspot, and Carsspot (the "Apps") and the Spotapps website (the "Service"). By using the Service, you agree to these terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
2. Your account
- You're responsible for keeping your sign-in credentials secure.
- Don't share your account with others.
- You may not create accounts using automated means or impersonate others.
- You're responsible for activity on your account.
3. Acceptable use
You agree not to:
- Post content that is unlawful, defamatory, obscene, harassing, or hateful.
- Post content that infringes intellectual property rights of others.
- Post photos of vehicles where you weren't physically present, or photos that mislead others about the catch.
- Spam, scrape, or otherwise abuse the Service.
- Attempt to reverse engineer, decompile, or hack the Apps.
- Use the Service to stalk, harass, or harm others.
4. Your content
You retain ownership of content you post (photos, notes, etc.). By posting, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content in connection with the Service.
This licence ends when you delete the content or your account, except that we may retain backup copies for up to 90 days.
5. Spotting rules
By using the Service, you agree to spot in good faith:
- Spots should reflect what you actually saw in person.
- Photos should be of the vehicle you claim to have spotted (not from a stock photo or someone else's photo).
- You may not mark a common car as "special edition" to gain more points — this is a community-curated rating and abuse undermines the system for everyone.
6. Pro subscription
We may offer a paid "Pro" subscription that unlocks additional features. Pro subscriptions are billed through Apple App Store or Google Play. You can cancel at any time through your store account. Refunds are handled per the store's policies.
7. Termination
We may suspend or terminate your account if you violate these terms. You can delete your account at any time from the app's Settings menu.
8. The Service is provided "as is"
We provide the Service on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising from or related to your use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim, or £100, whichever is greater.
We are not liable for indirect, incidental, consequential, or punitive damages.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
11. Changes to terms
We may update these terms from time to time. Material changes will be notified via the apps. Continued use after changes constitutes acceptance of the new terms.
12. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales, unless mandatory consumer protection laws in your country of residence provide otherwise.
